Difference between Anticipatory bail and regular bail
Anticipatory bail is also known as pre-arrest bail. It is applied by the accused before his/her arrest. It is applied under section 438 of Criminal procedure code. Court may grant Anticipatory bail before arrest so that accused would not be arrested by the police during investigation or trial.
Regular bail is applied after arrest and the provisions of this bail are mentioned in section 437 and 439 or CRPC. After arrest accused may apply for regular bail, and may request to the court to release him on bail. Court may also imposed certain conditions on the accused at the time of granting Anticipatory and regular bail.
