Who can transfer the investigation
- Home secretary of the state, he himself or on the recommendation of SP/IG/DGP
- High court of the state, in the writ petition or petition under section 482 CRPC
- At the time of filing of charge-sheet concerned magistrate may also handover the case for further investigation, to these agencies
When the case may be transferred
- At any time before completion of investigation
- After completion of investigation, case may also be transferred for further investigation through these agencies
Who can apply for transfer of the case
- Complainant, or
- Victim, or
- Accused, or
- Police
Reasons to transfer the investigation
- When police is not doing investigation fairly
- When police is making unnecessary delay in investigation
- When police is not collecting the evidence or itself involve in deleting the evidence
- When any officer of the police involve in the crime and who can influence the investigation
- When the quality of investigation suffers
- When accused and victim, can influence the police
- In the interest of justice, by looking to the facts of the case
